TERMS AND CONDITIONS FOR USING THE CEFNGWLAD.ORG WEBSITE
The CefnGwlad.org website (referred to as the “Website”) is a resource on the internet for individuals, businesses, groups and organisations based in rural Wales. It is accessible to all, from any PC equipped with an appropriate web browser.
A person using any part of the Website is deemed to accept the Terms and Conditions of use which are noted below. These Terms and Conditions contain all the terms of your agreement with WRF relating to your use of the Website. Your use of the Website, any downloaded material from it and the operation of these Terms and Conditions shall be governed by, construed and interpreted in accordance with the laws of Wales/UK and you agree to submit to the non-exclusive jurisdiction of the Welsh/UK Courts.
1. Ownership
The Website is owned and operated by Wales Rural Forum (referred to as “WRF”), Unit 8B, Cefn Llan Science Park, Aberystwyth, Ceredigion SY23 3AH. Any data provided by visitors to the Website is managed by WRF.
2. Website Content
2.1 The information provided on the Website is not an invitation or recommendation to buy any products or services that may be featured.
2.2 WRF hopes and intends to promote uninterrupted access to the Website, but it may be suspended, restricted or terminated without notice at any time.
2.3 WRF reserves the right to change, modify, substitute or remove without notice any information on the Website from time to time.
2.4 WRF has no responsibility or liability for the contents of any other websites to which the Website has links.
3. Intellectual Property
3.1 Copyright in the material contained in the Website, together with the Website design, text and graphics, and their selection and arrangement belong to WRF.
3.2 None of the material in the Website may be reproduced or redistributed without the written permission of WRF. You may, however, download or print a single copy for your own non commercial off-line viewing.
3.3 Product and company names mentioned on the Website may be the trademarks or registered trademarks of their respective owners. Any personal data you provide on the Website is subject to the Data Protection Act 1998.
4. Exclusions of liability
4.1 WRF will take all reasonable steps to ensure that the data on the Website is accurate and will correct any errors or omissions as soon as practicable after being notified of them.
4.2 WRF does not monitor, verify or endorse information submitted by third parties for posting on the Website and you should be aware that such information may be inaccurate, incomplete or out of date. WRF does not guarantee that the Website will be fault free and does not accept liability for any errors, inaccuracies or omissions.
4.3 WRF has no liability for any losses or claims arising from inability to access the Website, or from any use of the Website or reliance on the data transmitted using the Website.
4.4 WRF is not liable for any loss of profit, revenues, goodwill, opportunity, business, anticipated savings or other indirect or consequential loss of any kind in contract, or otherwise arising out of use of the Website.
5. Use of the Website
5.1 Any person using the Website will not:
use this Website in a manner which causes or may cause an infringement of the rights of any other party
use any software, routine or device to interfere or attempt to interfere electronically or manually with the operation or functionality of the Website, including, but not limited to, uploading or making available files containing corrupt data or viruses by whatever means deface, alter or interfere with the Website or the underlying software code
take any action which imposes an unreasonable or disproportionately large load on the Website.
5.2 Without prejudice to any other rights available to it, WRF reserves the right to deny any person access to the Website where WRF (in its absolute discretion) believes that he/she is in breach of these Terms and Conditions.
6. Changes to this Website
6.1 WRF may make improvements or changes to the information, services, products and other materials on Website, or terminate the Website, at any time without notice.
6.2 WRF may modify these Terms and Conditions at any time, and such modification will be effective immediately upon posting of the modified Terms and Conditions on the Website. Accordingly, a person’s continued access or use of this Website is deemed to be his/her acceptance of the modified Terms and Conditions.
7. TERMS AND CONDITIONS FOR GALLERY MEMBERS
A qualifying organisation or community group must agree to the following additional Terms and Conditions before it may become a member of the CefnGwlad.org Gallery (referred to as the “Gallery”).
7.1 WRF has set aside space in the Gallery for organisations and community groups in rural Wales (each being referred to as a "Gallery Member") to freely publish information about or relating to their interests.
7.2 WRF will provide the Gallery Member free of charge the use of such software (referred to as the "Software") and know-how (referred to as the "Know-how") as WRF in its absolute discretion deems necessary to construct and maintain a webpage within the Gallery (referred to as the "Member Webpage").
7.3 Subject to clauses 7.4 and 7.5 below, WRF will allow the Gallery Member free access to create and maintain a Member Webpage.
7.4 WRF reserves the absolute right to refuse to permit any individual or organisation from becoming a Gallery Member.
7.5 WRF retains the absolute right to remove at any time without notice the Member Webpage or any material on the Member Webpage.
7.6 The Gallery Member agrees to:
ensure the Member Webpage does not contain any material which is illegal, indecent, dishonest, untruthful, defamatory or obscene or any other material which WRF reasonably believes is inappropriate for publication on a website aimed at a family audience
ensure the Member Webpage is not linked to any other internet website which WRF reasonably believes contains material which is inappropriate for a website aimed at a family audience
ensure that the Member Webpage does not contain material that breaches any intellectual property rights, including but not limited to copyright, of any third party
publish on the Member Webpage notices which WRF may reasonably request from time to time
permit WRF to place advertisements on the Member Webpage
inform WRF of any complaint it receives about the Website or Member Webpage as soon as practicable thereafter
7.7 If WRF is informed of a complaint by the Gallery Member, the parties shall forthwith agree a course of action for handling that complaint. The Gallery Member agrees that it shall not respond to a complainant without such prior consultation and agreement of WRF.
7.8 The Gallery Member acknowledges and agrees that WRF shall not be liable for a third party creating a Member Webpage in the name of a Gallery Member without that Gallery Member’s authorisation or consent, or any consequences resulting from the same.
7.9 The Gallery Member shall not:
use the Member Webpage for the purpose of financial gain
permit any third party to use the Member Webpage for the purpose of financial gain
insert into the Member Webpage hyperlinks to any other website apart from its own website, if it has one.
7.10 The Gallery Member acknowledges that any and all copyrights or intellectual property rights existing in WRF are and shall remain the sole property of WRF.
7.11 The Gallery Member shall permit WRF to reproduce and/or publish free of charge any material it has placed on the Member Webpage on the Website, in the newsletter distributed by WRF to which the Website relates, or in any advertisements relating to either of the same.
7.12 The Gallery Member agrees not to publish anything that is defamatory, illegal, indecent, dishonest, untruthful or which amounts to a contempt of court or an infringement of any intellectual property rights belonging to a third party and, if any of these should occur, the Gallery Member agrees to indemnify WRF for any losses it suffers.
7.13 Nothing in these Terms and Conditions shall be construed as establishing or implying any partnership between the parties and nothing shall be deemed to constitute either of the parties as the agent of the other party.
7.14 The rights granted to the Gallery Member under these Terms and Conditions are personal to the Gallery Member and may not be assigned.
7.15 By ticking on the “I agree” box, you apply for and on behalf of a Gallery Member to be provided with the means of constructing and maintaining a Member Webpage and if the application is accepted, that Gallery Member will be bound by these Terms and Conditions.
8. TERMS AND CONDITIONS FOR THE DISCUSSION FORUM
Any person using the CefnGwlad.org Discussion Forum (referred to as the “Discussion Forum”) must agree to the following additional Terms and Conditions before it may use the Discussion Forum.
8.1 You must not post any knowingly false, defamatory, abusive, obscene, vulgar, slanderous, hateful, threatening, racist, sexually-oriented material, or any other material that may violate any applicable laws. Doing so may lead to you being immediately and permanently banned (and your service provider being informed). The IP address of all posts is recorded to aid in enforcing these conditions.
8.2 You must post any copyrighted material unless the copyrighted material is owned by the user.
8.2 The webmaster, administrator and moderators of the Discussion Forum have the right to remove, edit, move or close any topic at any time should they see fit.
8.3 Any information that is entered by you will be stored in a database. While this information will not be disclosed to any third party without the your consent, the webmasters, administrators and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised. This forum system uses cookies to store information on the user’s local computer. These cookies do not contain any of the information the user has entered to register; they serve only to improve the user’s viewing pleasure. The e-mail address is used only for confirming the your registration details and password (and for sending new passwords if the current one is forgotten). WRF does not pass on any e-mail addresses to any third party.
8.4 While the administrators and moderators of the Discussion Forum will attempt to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every message. It is stressed, therefore, that all posts made to the Discussion Forum express the views and opinions of the author and not of WRF, the administrators, moderators or webmasters (except for posts by these people) and hence will not be held liable. WRF does not vouch for or warrant the accuracy, completeness or usefulness of any message, and is not responsible for the contents of any message.
8.5 If you feel that a posted message is objectionable, please contact WRF immediately by e-mail, and we will make every effort to remove any objectionable messages within a reasonable time frame, if we determine that removal is necessary.
8.6 You remain solely responsible for the content of your messages, and your agree to indemnify and hold WRF harmless with respect to any claim based upon transmission of your message(s). WRF reserves the right to reveal your identity (or whatever information we have about you) in the event of a complaint or legal action arising from any message posted by you.
